What Is Eminent Domain?
Eminent domain refers to the power possessed by the state over all property within the state; specifically it is the power of the government to take
private property from citizens and business for a “public use.” In some jurisdictions, the state or local governments can assign the power of eminent domain to certain public and private companies, such as utility companies, so that they can bring eminent domain actions to run telephone, power, water, or gas lines; or the Department of Transportation so they can build roads and/or highways.
Under article X, Section 6 of the Florida Constitution, the owner of any appropriated land is entitled to full compensation, usually defined as the fair market value of the property plus additional components of compensation which will be discussed further below.
